The Migration Amendment (Strengthening Employer Compliance) Act 2024 amended the Migration Act 1958 to introduce new laws to tackle migrant worker exploitation. The laws deter employers and others in the labour chain from using a person’s migration status to exploit them. They help create a level playing field for businesses doing the right thing.

​​​​​​​Employers must follow laws relating to employment, including the laws set out under the Fair Work Act and Migration Act. ​​​Workers are covered by the Fair Work Act regardless of their immigration status.

1. Expression of Interest (EOI)

  • Step 1: Applicants must submit an Expression of Interest (EOI) through SkillSelect, which is an online application form where they provide details about their qualifications, work experience, English language skills, and other factors.
  • The EOI allows applicants to express their interest in being considered for a skilled visa but does not guarantee a visa. It is not a visa application.

2. Points Test

  • Based on the information provided in the EOI, applicants are assigned points for factors such as age, English proficiency, education, work experience, and occupation. Applicants must meet a minimum points threshold to be eligible for a skilled visa.
  • SkillSelect ranks EOIs based on the points score and other criteria. Higher-ranking EOIs are more likely to be invited to apply for a visa.

3. Invitation to Apply

  • Step 2: Once an applicant’s EOI is submitted, they may be invited to apply for a skilled visa, depending on their score and the demand for their occupation in Australia.
  • Invitations are typically issued during regular selection rounds or through State Nomination.
  • If invited though State Nomination, applicants must submit an application to the relevant State or Territory for assessment.

4. Visa Application

  • After receiving an invitation, applicants must submit a formal visa application. This includes providing supporting documents such as qualifications, work experience references, and proof of English proficiency.

SkillSelect Categories

  • SkillSelect is used for various skilled migration visa programs, including:
  • Skilled Independent Visa (subclass 189): For skilled workers not sponsored by an employer, family, or state.
  • Skilled Nominated Visa (subclass 190): For skilled workers nominated by an Australian state or territory government.
